The action was brought for alleged violations of the equal protection clause, the due process clause, and the Voting Rights Act of 1965, 42 U.S.C. § 1971, due to a denial of voting on annexation of Avon Township by the City of Rochester. The action proceeded as a class action, with plaintiffs representing all township residents and the townships in the State of Michigan. The defendants are the Executive Secretary and individual members of the Michigan State Boundary Commission. The City of Rochester was granted the right to intervene as the annexing city.
